These terms and conditions apply to the use of the growth calculation on this website. They describe what you can expect from us, what we expect from you, and how subscriptions, payments and cancellation work.
Version 1.0, last updated:15-10-2026
1. Who we are
The growth calculation is provided by INCITE, located at Nijetrijne, the Netherlands, registered with the Dutch Chamber of Commerce under number 39073606. You can reach us via the contact page.
2. Definitions
- Service: the growth calculation and all features on this website, such as entering measurements, calculating the growth phase, team overviews, and do’s and don’ts.
- User: anyone with an account: coach, administrator or parent.
- Coach: an independent coach or trainer with their own subscription.
- Organisation: a club, school or other institution with a subscription for multiple coaches.
- Administrator: the user who manages the account on behalf of an organisation.
- Parent: a parent or carer who, with consent, views their own child’s data.
3. Applicability
These terms apply to every account and every subscription. By creating an account, you agree to them. Deviating arrangements only apply if we have recorded them with you in writing. The processing of personal data is also governed by our privacy policy and, for organisations, the data processing agreement.
4. Account
- When creating your account, you provide correct and complete information and keep it up to date.
- Your account is personal. Do not share your login details with others.
- If you suspect that someone else has access to your account, change your password immediately and let us know.
- An administrator decides which coaches have access to the organisation and to which teams. The organisation is responsible for whom it gives access.
5. Children’s data
Whoever enters a child’s data is responsible for it. That is the organisation or the independent coach. We process that data on their behalf.
- Ask a parent or carer for consent in advance if the child is under 16, and record that consent.
- Only enter the data needed for the calculation: name, date of birth, sex, team and measurements.
- Do not enter medical information or other sensitive data, including in free text fields.
- Delete a child’s data when they are no longer in a team or when consent is withdrawn.
6. The calculation
The growth calculation uses the Mirwald formula to estimate how far a child is from the peak of the growth spurt. It is an estimate with a margin of about half a year, sometimes more. The outcome depends on the accuracy of the measurements.
The calculation and the do’s and don’ts are a tool for adjusting training. They are not medical advice, not a diagnosis, and not intended for selecting or assessing children. If a child has complaints or you are concerned about their growth, consult a (sports) doctor or physiotherapist.
7. Subscriptions and prices
- A subscription always runs for one year, counted from the start or the last renewal.
- Current prices are shown on the website. All prices are in euros and include 21% VAT.
- Organisations may receive a tiered price depending on the number of coaches or teams. Discount codes only apply under the conditions stated with the code and cannot be exchanged for cash.
- We may change prices for each new subscription year. We will let you know at least 30 days before the renewal. If you do not agree, you can cancel with effect from the end of the current year.
8. Payment for coaches
- You pay the first time in advance by iDEAL or credit card through our payment provider Mollie.
- After that, your subscription is renewed automatically every year and the amount is collected automatically.
- If an automatic payment fails, you will be notified and can pay again. If you do not pay, your access ends at the end of the paid period.
9. Payment for organisations
- New organisations can first try the service free of charge for [14] days. The trial ends automatically; no invoice is sent unless you request one yourself.
- Organisations pay by invoice. You receive the first invoice after requesting the subscription. After that, you receive the invoice for the following year approximately 30 days before the end date each year.
- The payment term is [14] days from the invoice date.
- If the invoice has not been paid after the due date, the organisation can still view and export the data, but can no longer add or change anything. As soon as payment is received, everything works as before.
- Organisations owe statutory interest and reasonable collection costs if an invoice remains unpaid after a reminder.
10. Right of withdrawal
If you take out a subscription as a consumer, you are in principle entitled to a 14-day cooling-off period. Because you get access to the service immediately after payment, we ask you to agree to immediate delivery when you subscribe. By doing so, the right of withdrawal lapses. [Have it legally reviewed whether and how this is recorded in the payment process.]
There is no right of withdrawal for organisations and coaches acting in the course of a profession or business.
11. Cancellation and termination
- Coaches can stop automatic renewal at any time via Subscription in their account. Access continues until the end date.
- Organisations can cancel the subscription via Subscription in their account by choosing not to renew. Do this before the annual invoice is sent, approximately 30 days before the end date. Access continues until the end date.
- Amounts already paid are not refunded on cancellation, not even pro rata.
- You can also delete your account or organisation yourself. All data is then deleted immediately and automatic renewal stops.
- We may block or terminate an account in the event of misuse, conduct in breach of these terms or the law, or if invoices remain unpaid after repeated reminders.
12. After the subscription ends
After the subscription ends, you can still view the data and export it as an Excel or CSV file for [number] months. Administrators receive a warning by email in advance. After that, we automatically delete all teams, children and measurements of the organisation. We keep invoices for 7 years because of the statutory tax retention obligation.
13. Availability and maintenance
We do our best to keep the service available and secure at all times, and we make regular backups. We cannot guarantee that the service will always work without interruptions or errors. We carry out planned maintenance outside usual training times as far as possible and announce it in advance where reasonably possible. We may improve the service and change features, as long as the core of the service remains the same.
14. Liability
- We are not liable for decisions made on the basis of the calculation, such as about training, load or team selection, nor for injuries or other consequences thereof.
- We are not liable for damage caused by incorrectly entered data, or by the service being temporarily unavailable.
- Our liability is in all cases limited to the amount you paid for the subscription in the twelve months before the damage occurred.
- These limitations do not apply in the event of intent or deliberate recklessness on our part.
15. Intellectual property
The software, texts, do’s and don’ts, images and the design of the website belong to [company name] or our licensors. You may use them for your own coaching practice or organisation, but you may not copy, resell or publish them without our permission. The data you enter yourself remains yours or your organisation’s.
16. Changes
We may change these terms. In the case of important changes, we will inform you by email at least 30 days in advance. If you do not agree, you can cancel with effect from the date on which the change takes effect. The most recent version is always available on this page.
17. Complaints and governing law
If you have a complaint, please let us know through the contact page. We will respond within 14 days. These terms are governed by Dutch law. Disputes will be submitted to the competent court in [city], the Netherlands, unless the law designates another court. As a consumer, you can also go to the court in your own place of residence.
